2. Eligibility

3. Products and pricing

We try to display our products, colours and specifications as accurately as possible, but we cannot guarantee that your screen renders colour exactly. Prices are shown in US dollars and may change without notice. We reserve the right to refuse or limit any order, and to correct pricing or description errors, including after an order has been placed — in which case we will contact you and offer a full refund.

4. Orders and payment

Your order is an offer to buy. A contract is formed when we dispatch the goods. Payment is taken at checkout through our payment provider. You confirm that you are authorised to use the payment method supplied.

5. Shipping and risk

Shipping timings on the Shipping page are estimates, not guarantees. Risk in the goods passes to you on delivery.

6. Returns

Returns are governed by our Refund Policy, which forms part of these terms.

7. Accuracy of your information

You agree to provide current and accurate purchase information, and to update it as needed so we can complete your order and contact you.

All content on this site — text, photography, graphics, design and the General Birchmark name — belongs to us or our licensors and may not be reproduced or used commercially without written permission.

You may not use the site to break any law, infringe anyone’s rights, transmit malicious code, harvest data, or interfere with the security of the site.

10. Disclaimer and limitation of liability

The site is provided “as is”. To the fullest extent permitted by law we exclude implied warranties and are not liable for indirect, incidental or consequential loss. Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or fraud. Our total liability for any claim relating to an order is limited to the amount you paid for it.
